TERMS AND CONDITIONS OF SALE
Purchases of products or services made on onestore.moda (the “Site”) are governed by the following conditions (“Conditions”). By clicking on the “I accept” button, the user accepts the Conditions without limitations or reservations. 1. Services offered by the site
The site allows you to use the services of purchasing clothing and fashion accessories (the "Products") with home delivery, i.e. with delivery to third parties via delivery services exclusively on Italian territory. In order to purchase the products, it is not necessary to register on the site by specifying whether you intend to register and then make purchases as a company, sole proprietorship/freelancer, private individual or association, also specifying the nationality of the user. Purchases of products made by private users will be subject to the applicable regulations on consumers, pursuant to the provisions of Legislative Decree 06.09.2005 n. 206 (the "Consumer Code"). All final prices of the Products displayed on the Site are expressed in euros and include VAT. The prices of the Products may be subject to periodic changes. For all Products and offers, shipping costs are to be considered excluded, therefore borne by the user.
2. Product selection and purchasing methods
The user can proceed to the selection of the Products, selecting them from time to time, and adding the desired quantities to the cart. Some images are indicative and therefore may differ from the appearance of the delivered Product.
Once you have selected the desired items, a screen will be displayed to send the order with an indication of the costs and total expenses, so as to proceed to checkout and complete the order with a payment method of your choice (see Payment Methods). The order is considered sent with an email that arrives immediately in the mailbox indicated by the customer during the purchase phase.
The sales contract for products on the website www.onestore.moda can be considered concluded when the purchase order made by the customer arrives and onestore.moda accepts it by communicating via automatic email to the customer. When the customer confirms the purchase order electronically, he/she declares to have read and accepted these general contract conditions and, therefore, undertakes to observe and respect them.
3. Payment Methods
The customer can proceed to make the payment due by choosing between the various methods listed during the purchase phase in the "Cart" section. The customer can purchase the Services online and make payments by credit card (Visa or MasterCard), via Paypal, Sumup or Scalapay .
4. Delivery and shipping times
ONESTORE.MODA will deliver the products selected and ordered through the methods indicated on the website. Delivery times are estimated at 48/72 working hours throughout Italy. The delivery dates indicated in the order are purely indicative and may be subject to variations and delays in delivery caused by the Courier. ONESTORE.MODA will not be responsible in any case for possible damages caused by delays in delivery.
Each order is considered as a shipment. For multiple orders from the same user, the orders will be grouped into a single shipment shortly.
SHIPPING COSTS
Shipping within the national territory costs €5.00, with the exception of the islands where the cost for a single shipment is €6.00.

Collection times: After receiving the order confirmation by email, you can collect within 7 days of receiving the email, during store opening hours.
After this period, neither the availability of the product nor the price displayed at the time of ordering will be guaranteed.
Note: In order to collect your order, you must show up at the store with an identification document and the order summary email that can be printed or shown on your device, otherwise it will not be possible to collect your order. 5. Right of withdrawal
5.1. In the case of purchases of Products as a consumer pursuant to the provisions of the Consumer Code, you have the right to withdraw from the contract, without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day "on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods." To comply with the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit declaration (e.g. a letter sent by post or by e-mail).

5.2. Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such reimbursements will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. You are requested to send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
The costs of returning the Products are borne by the user.
Pursuant to art. 56, paragraph III, Legislative Decree 06.09.2005, n. 206 (Consumer Code), ONESTORE.MODA reserves the right to withhold the refund until it has received the Products or until the user has demonstrated that he has returned the Products, depending on which situation occurs first.
5.3 Exceptions to the Right of Withdrawal
The right of withdrawal referred to in Articles 52 to 58 of the Consumer Code for distance contracts and contracts negotiated outside commercial premises is excluded in relation to:
a) service contracts after the complete performance of the service if the performance has begun with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full performance of the contract by the professional;
(b) the supply of goods or services the price of which is linked to fluctuations in the financial market which the trader is unable to control and which may occur during the withdrawal period;
c) the supply of goods made to measure or clearly personalized;
d) the supply of goods which are liable to deteriorate or expire rapidly;
e) the supply of sealed goods which are not suitable to be returned for hygiene or health protection reasons and have been opened after delivery;
f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;
g) the supply of alcoholic beverages, the price of which has been agreed upon at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on fluctuations on the market which cannot be controlled by the professional;
h) contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of such a visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out the maintenance or repairs, the right of withdrawal applies to such additional services or goods;
(i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery;
l) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;
m) contracts concluded at a public auction;
(n) the provision of non-residential accommodation, the transport of goods, car rental services, catering services or services relating to leisure activities where the contract provides for a specific date or period of performance;
o) the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's express consent and his acknowledgment that in that case he would lose his right of withdrawal.
6. Warranty and Returns
All products are covered by a guarantee according to Legislative Decree 206/2005 “Consumer Code”. (see link)
To assert the guarantee, it is necessary to keep the accompanying invoice or the sales document that are delivered together with the package, and contact our customer service via email at info@onestore.moda.
The warranty is recognized provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation.
This guarantee (where no different indications are given) is reserved for the private customer, who purchases the goods for purposes not related to his/her professional activity. In the event of a lack of conformity, One Store will restore the conformity of the product through refund/replacement.
6.1 Product Replacement
The refund/replacement occurs by receiving the product that is in conformity with the return. The return shipping costs are paid by the customer.
ONESTORE allows you to exchange or return the purchased goods without additional transport costs for the buyer.
6.2 Exchange and return conditions
The goods must not be broken/deteriorated and in any case must not show signs of wear caused by use.
In the case of material provided with specific packaging (envelope/box etc.), this packaging must be used to re-insert the goods.
No more than 30 days must have passed from the date of receipt of the goods.
In case of products with supplier labels/tags, they must not be removed or damaged.
If the goods correspond to the above regulations, to make the exchange you must contact our Customer Service at info@onestore.moda communicating the references of your order, the items to be exchanged, the address, the date and any time preferences, to collect the goods to be replaced. The courier who will make the exchange, will deliver and collect the package at the same time at the agreed address.
7. ODR
The consumer residing in Europe must be aware that the European Union has established a tool for the resolution of disputes. This tool can be used in a non-judicial manner. Here is the link https://ec.europa.eu/consumers/odr/
8. Copyright & Trademarks
The trademarks on this site are for the exclusive use of the site owner. They cannot be reproduced in whole or in part without the authorization of the author.
9. Disclaimer
ONESTORE.MODA shall not be held liable towards the client and/or beneficiary of the service if different, for any reason, whether direct or indirect, deriving from any errors of any nature.
ONESTORE.MODA cannot be held responsible in any way for any delays or damages attributable to the fault of the Courier.
10. Final clause
This Agreement supersedes and replaces any prior agreement, understanding, negotiation, written or oral, between the parties regarding the subject matter of the aforementioned contract.
11. Competent court
The legislation applicable to these Conditions is Italian law.
For any and all disputes relating to the interpretation, execution and termination of these Conditions, the Court of Vasto will have exclusive jurisdiction, except in the case in which the Customer has acted and concluded the contract as a consumer for purposes other than his entrepreneurial or professional activity; in this case, the Court of the place where the Customer has his residence or domicile will have exclusive jurisdiction, if located in the territory of the Italian state.
For anything not expressly indicated and regulated in these Conditions, Italian law applies.
